Terms of Service

1. Acceptance of Terms

By accessing or using LockTheTrip (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including trip organizers (“Champions”) and trip members.

2. Description of Service

LockTheTrip is a trip coordination tool that allows a trip organizer to propose date options, collect availability responses from group members via SMS, and lock in a final trip date once a minimum attendance threshold is met.

3. Eligibility

You must be at least 18 years old to use LockTheTrip. By using the Service, you represent and warrant that you meet this requirement. The Service is intended for use in the United States and Canada.

4. Trip Organizer Responsibilities

As a trip organizer (Champion), you are responsible for:

• Ensuring you have a pre-existing relationship with each person whose phone number and email address you enter into the Service.
• Obtaining consent from trip members before submitting their contact information.
• Providing accurate contact information for all trip members.
• Ensuring that all members are aware they will receive SMS messages from LockTheTrip in connection with the trip.

You agree not to add individuals to a trip without their knowledge or consent. Misuse of the Service to send unsolicited messages is strictly prohibited and may result in immediate termination of your access.

5. SMS Communications

By being added to a trip, trip members consent to receive transactional SMS messages from LockTheTrip. These messages include trip invitations, availability reminders, and trip confirmation notifications.

To opt out of SMS messages at any time, reply STOP to any message you receive. You will receive no further messages after opting out. Reply STARTto opt back in. Reply HELP for assistance.

Message and data rates may apply. Message frequency varies per trip. LockTheTrip is not responsible for any charges incurred from your mobile carrier.

6. Acceptable Use

You agree not to use the Service to:

• Send messages to individuals who have not consented to receive them.
• Harass, threaten, or harm any person.
• Violate any applicable local, state, national, or international law or regulation.
• Impersonate any person or entity.
• Attempt to gain unauthorized access to any part of the Service.
• Use the Service for any commercial marketing or advertising purposes.

7. Intellectual Property

All content, design, code, and materials on LockTheTrip are the property of LockTheTrip and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We make no guarantees regarding SMS delivery, as delivery is subject to carrier availability and conditions outside our control.

9. Limitation of Liability

To the fullest extent permitted by law, LockTheTrip shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to lost profits, loss of data, or failure of SMS delivery. Our total liability to you for any claim arising from your use of the Service shall not exceed $100.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the Service after changes constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
